By reading all of the statements contained in this document and ticking the appropriate box, I hereby confirm and accept all of its terms, conditions, and statements, including those parts relevant both generally to Energy Alchemy events and specifically to Tantra Massage events within the Energy Alchemy organization.

Section 1 - Definition of Event 

An event is any workshop, course, or retreat offered by Energy Alchemy whether in-person or online format.

 

Section 2 - Release of Liability

In consideration of my participation in Energy Alchemy events, the individual, group, organization, business, spectator, or other, does hereby release and forever discharge Energy Alchemy, their officers, board, and employees, jointly and severally from any and all actions, causes of actions, claims, and demands for, upon or by reason of any damage, loss or injury, which hereafter may be sustained by participating in any activity held under the name Energy Alchemy. 

 

I acknowledge that Energy Alchemy does not provide liability insurance for the protection of individuals, groups, organizations, businesses, spectators, or others who may participate in any activity held under the name Energy Alchemy. 

 

I HEREBY ASSUME ALL OF THE RISKS OF PARTICIPATING IN ANY/ALL ACTIVITIES ASSOCIATED WITH ENERGY ALCHEMY PRACTICES AND TEACHINGS, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.

 

I certify that I am physically fit and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in this activity.

 

I acknowledge that this Participation Agreement and Release of Liability Form will be used by the event holders, sponsors, and organizers of the activity in which I may participate and that it will govern my actions and responsibilities at said activity.

 

In consideration of my application and permitting me to participate in this activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:

 

• I waive, release, and discharge from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from this activity,

• Indemnify, hold harmless, and promise not to sue the entities or persons mentioned in this form for any and all liabilities or claims made as a result of participation in this activity, whether caused by the negligence of release or otherwise.

 

I acknowledge that Energy Alchemy and its directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific activity on their behalf.

 

I acknowledge that Energy Alchemy training and techniques may involve a test of a person’s physical and mental limits and carries with it the potential for death, serious injury, emotional instability, and property loss. The risks include but are not limited to, those caused by facilities, temperature, weather, condition of participants, equipment, lack of hydration, and actions of other people including, but not limited to, participants, volunteers, teachers, and/or producers of the activity. These risks are not only inherent to participants but are also present for volunteers.

 

I hereby consent to receive medical treatment which may be deemed advisable in the event of injury, accident, and/or illness during this activity.

 

The Release of Liability Form shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

 

Section 3 - Tantra Massage Events

 

3.1 APPLICANT’S RESPONSIBILITIES, DECLARATION OF CONSENT TO ALL RISKS, AND CLARIFICATION OF CONTENT

 

• I hereby give my consent to participate in and to give and receive massage (including genital massage and intimate touch) and/or other bodywork as well as instruction in Tantra Massage, Tantra Yoga, meditation, and energy work. 

• I understand such activities may include the use of massage oils, gels, creams, and/or props provided by Energy Alchemy, its teachers, trainers, assistants, or related personnel and I acknowledge and agree that I am doing so at my own risk. I hereby declare that I am fully aware and accept that my health and safety, with respect to such training, are my sole responsibility.

• Energy Alchemy Tantra Massage courses have a proven record for safety and effectiveness. However, in very rare cases, participation in the above-listed activities and training may potentially result in bodily injury, blood clotting issues, stroke, Bell’s Palsy, paralyzation, organ failure, structural and physical discomfort, purification effects, hyperventilation, increased heart rate, emotional releases, among other effects, up to and including my own death. I accept full responsibility for myself and my health and indemnify fully and hold harmless Energy Alchemy and all directors, officers, employees, controlling persons, fiduciaries, and other agents and affiliates of the Company.

 

My decision to receive training and participate in Tantra Massage courses with Energy Alchemy is voluntary, and I know of, understand, and assume any and all risks associated therewith.

 

3.2 NUDITY, INTIMATE TOUCH, AND GENITAL MASSAGE

I hereby declare that in full awareness and agreement, I choose to participate in Energy Alchemy’s Tantra Massage events and I am aware and fully accept that these courses include and involve nudity, intimate bodily touch between various participants and myself, genital massage (including inner vaginal massage for women and penis and testicular massage for men), multiple exchanges of massage partners during the event, and full-body touch. 

 

3.3 POTENTIAL RISKS AND SIDE EFFECTS OF TANTRA MASSAGE

By signing this document, I hereby confirm that I have been fully informed and I accept and agree fully to all the health risks mentioned henceforth. 

 

Also, I fully accept and agree to participate in an Energy Alchemy Tantra Massage course with full knowledge and awareness of the health risks and possible damages mentioned below:

 

• Blood Clots: The American Massage Therapy Association (AMTA) cautions massage therapists about the risks of massaging a client with high blood pressure. The pressure exerted during a massage could potentially cause arterial plaque to rupture and release blood clots into the system. Though the risk is low for such an event, blood clots can travel to the heart or brain. Clients with deep vein thrombosis (DVT), a condition that causes blood clots to develop in the deep veins of the body, are especially at risk. Massage greatly increases the risks of a clot being released and traveling to the lungs.

• Nerve Damage: Some forms of massage when there is an exertion of too much pressure may result in temporary nerve damage. 

• Infectious Skin Conditions: A number of infectious conditions of the skin can be transmitted during a massage, despite the best efforts of Energy Alchemy to screen all applicants. These include herpes, cold sores, shingles, rashes, warts, and ringworm. 

• Temporary Side Effects: Side effects, otherwise known as purification effects, may include temporary pain, soreness, discomfort, bruising, swelling, and a sensitivity or allergy to massage oils. Also, nausea, vomiting, temporary or longer-term diarrhea, various body discomfort symptoms, emotional expressions, and emotional release may manifest, among other conditions.

 

3.4 WHEN TO AVOID MASSAGE

Certain medical conditions may increase the risk of experiencing negative side effects from massage. These include cancer, severe heart conditions, high blood pressure, fractured or broken bones, blood clots, skin rashes and infectious diseases of the skin, sexually transmitted diseases, burns, lesions, any forms of arthritis and osteoporosis, mysterious pain, and other diseases or dysfunctions.

 

If I suffer from any of these conditions or other serious illnesses, I commit to inform Energy Alchemy when applying for or registering for an event and to consult my physician before joining a Tantra Massage event.

 

As a pregnant woman, I am aware that I am required to inform Energy Alchemy of my pregnancy before joining any Tantra Massage event and to consult my healthcare provider before participating. 

 

3.5 REQUIRED LEVEL OF HEALTH AND MOBILITY

The practice massage sessions in our Tantra Massage events are done from the floor on padded massage spaces created from the supplies that you are required to bring with you to the event (i.e. yoga mats, blankets, etc.). 

 

It is necessary that you have a reasonable level of physical health and fitness in order to join this training and participate fully. You should be free from severe or debilitating injuries that prevent you from kneeling on the floor and massaging your partner for an extended period of time. 

 

Massage practice sessions can be anywhere from 1-3 hours in length and the necessary stamina, flexibility, strength, and mobility to sustain this level of physical activity is crucial in order to join. Please keep this in mind before applying or registering. 

 

Section 4 - Covid 19

• I hereby declare that I am fully aware of Covid-19 and the global CoronaVirus pandemic and I assume all responsibility for joining an Energy Alchemy event at this time. I hereby declare that I am Covid-19 negative, to the best of my knowledge, am fully healthy, and I currently manifest zero symptoms, whatsoever, related to Covid-19 and associated variants.

• I hereby confirm that I will ONLY join an Energy Alchemy event if I have not manifested any symptoms related to Covid-19 or any other symptoms of illness at least 14 days prior to joining my chosen event (exception made to online events)

• I hereby confirm that I assume all responsibility and therefore fully release Energy Alchemy from any responsibility for my health regarding the Covid-19 infection or contamination. If for some reason I get infected with Covid-19 during an Energy Alchemy event, I hereby assume all responsibility and I am fully accepting all risks or dangers related to such infection.

• I hereby declare that I was fully informed by Energy Alchemy of any and all potential dangers of Covid-19 infection or contamination during events and that I accept all such risks and that I am releasing Energy Alchemy and all attending participants from any responsibility regarding such dangers of infection, contamination or “catching” Covid-19 during an event.

• I hereby also release Energy Alchemy and all event participants from any responsibility, if I discover at any time AFTER the event has ended, that I have become infected with Covid-19. I will not accuse, file suit or make any legal claim towards Energy Alchemy with regards to such infection with Covid-19.

• I am fully aware that in an event I will be sharing space and/or living together at a facility with anywhere between 20-100 people in close proximity. 

• I am fully aware that Tantra Massage events involve touch, massage, intimate touch, and various other close interactions that are not within social distancing guidelines nor do they involve the use of face masks. I am accepting all of this and I take full responsibility for any results coming from that. 

• I do not hold Energy Alchemy responsible for any non-adherence to guidelines mandated or recommended by the appropriate governing health authorities. Further to that, I do not hold Energy Alchemy responsible legally, or in any other form, for any of these potential risks or behavior.

• I confirm that I am obliged to notify the teaching team immediately if any Covid-19, or other illness-like symptoms, manifest during the event and I confirm that the event team has the right to exclude me from the course and course-related activities and ask me to leave the course venue immediately. I also confirm that in such a situation I am not eligible for any refund of the course fee.

 

Section 5 - Confidentiality and No Recording Policy

I hereby commit not to record (by means of video, audio, or any other means) the content, teaching materials, lectures, sessions, or any other content or teachings of an Energy Alchemy event in which I participate, online or in person. 

 

I am aware that if I breach this commitment, I may be expelled immediately from any event with no refund or compensation and I may become the subject of legal action as well as incur fines and legal/financial liability for copyright infringement.

 

I also hereby commit not to distribute course materials provided directly to me in any format – whether digital or printed, including online content from the Site or Energy Alchemy social media channels – to anyone, regardless of whether that person/those people may have previously joined an Energy Alchemy event. Unauthorized distribution of Energy Alchemy copyrighted and trademarked materials will be considered a breach of this agreement and violators will be subject to legal repercussions.

 

Section 6 - Right to Refuse Acceptance

I am aware, acknowledge, and accept that Energy Alchemy has the right to refuse the participation of myself or any person in any of its events. 

 

Furthermore, I am fully aware and accept in advance, that Energy Alchemy reserves the right to expel, dismiss, or send home me or any participant from any of its events at any time for the following reasons:

 

• Incompatibility/problematic behavior that disrupts harmony in the event

• Breaking the rule that stipulates no recording of any kind

• Disregarding or breaking any of the other rules of conduct as explained in the first teaching session of each event

• Aggressive or disrespectful behavior toward any teacher, staff member, or course participant

• Any other disturbing, abnormal, or adverse behavior that negatively impacts the event, the teacher(s)/assistants, or other participants

 

Such decisions will not be made lightly. However, if made, these decisions will be taken at the sole discretion of the event teacher(s) and will be final.

 

I understand and accept that in the case of my expulsion from any Energy Alchemy events, there will be no refund of any kind of my payments that have been made. I declare that I am fully aware of the “no refund” policy in case of expulsion from an event and I agree in advance to withhold any claims or requests for a refund. 

 

Section 7 - Waiver of Rights

In exchange for receiving any training or instruction from Energy Alchemy, I, for myself and on behalf of my heirs, executors, administrators, and personal representatives, hereby waive, release, discharge, and hold harmless Energy Alchemy from any and all liability for any and all injuries, including death, damages, or claims relating to or resulting from my participation in any and all events, now or in the future, foreseen or unforeseen. 

 

Further, I will indemnify and hold harmless Energy Alchemy from and against any and all claims, rights, damages, liabilities, losses, loss of employment-related costs, and all other costs and expenses (including reasonable attorney’s fees) arising from or in connection with any injuries to other persons or damage to property caused by or attributed to me.

Section 8 - Agreement to All Terms

I have read in detail and fully understand this Participation Agreement and Release of Liability regarding my participation in Energy Alchemy events and specifically regarding the potential risks and side effects associated with Tantra Massage and/or other bodywork done with and by Energy Alchemy.

 

I certify that I have read this document and I fully understand its content. I am aware that this is a release of liability and a contract and I agree to all terms of my own free will.

 

By ticking the respective box on the check-out page of the Energy Alchemy website, I certify I have read the terms and hereby legally agree to all content contained herein. 

 

I agree to sign this document in person and in physical form upon arrival at an Energy Alchemy event.
